Apple’s $500M slow iPhone settlement: Are you eligible to file a claim? - SILive.com

STATEN ISLAND, N.Y. -- Apple will pay up to $500 million in a class-action settlement after it was accused of slowing down older iPhones as it launched new models, according to published reports.

Apple has agreed to pay a minimum of $310 million up to a maximum of $500 million in the class-action settlement, court documents dated Feb. 28 state.

The settlement comes after customers alleged that Apple slowed down older iPhones after installing new operating systems or software updates when newer models were released, leading some owners to buy new batteries or new phones.

Consumers claimed Apple slowed down the phone to force buyers to upgrade to the latest iPhone, but in December 2017, Apple said it used the software updates to limit performance of older iPhones that may have battery issues that would cause unexpected shutdowns.

After an initial outcry, Apple offered replacement batteries for $79, later lowering that price to $29 in January 2018.

The class-action settlement covers people who bought an Apple iPhone 6, 6 Plus, 6s, 6s Plus, 7, 7 Plus, and SE devices running the iOS 10.2.1 or later operating system, and who ran these iOS versions before Dec. 21, 2017, according to court documents.

iPhone users who submit a claim could receive $25 per affected device, which may be adjusted due to the number of claims filed and for any additional legal fees and expenses approved by the court, the documents state.

The preliminary proposed settlement still requires approval by U.S. District Judge Edward Davila in San Jose, Calif., before eligible iPhone users can file a claim.

Apple’s most recent iPhone launch included the Apple iPhone 11, iPhone 11 Pro and the iPhone 11 Pro Max.
